These Terms of Service (“Terms”) govern your access to and use of the Holotype website at holotype.shop and the products and services offered through it (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by Holotype (“Holotype,” “we,” “us”), a private brand. Holotype publishes physical goods that bear scientific-plate artwork rendered from authoritative source data.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you represent that you meet this requirement and that the payment method you provide is yours to use.
3. Curator accounts
When the Curator account system is available, you will be responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized access. Until the account system launches, your order confirmation emails serve as your record of acquisition.
4. Orders, pricing, and payment
All orders are offers to purchase, accepted at our discretion. We may cancel an order or limit quantities for any lawful reason, including suspected fraud, pricing errors, or supply constraints. Prices are shown in U.S. dollars and may change without notice; the price in effect when you complete checkout applies to your order.
Payment is processed through Stripe. By submitting payment information you authorize Stripe to charge the full order amount to the payment method you provide.
5. First Edition, Legacy Edition, and the Registry
First Edition pieces are produced in a fixed, serialized run (typically 500 units). Once the cap is reached, no additional First Edition copies of that piece will be produced — this commitment is permanent. Legacy Edition pieces are produced on demand after the First Edition cap is reached and are not serialized.
Serial numbers, edition sizes, and acquisition records are maintained in the Holotype Registry. We will not release a Curator’s personal information through the Registry without that Curator’s consent.
6. Production and shipping
Plates are produced on demand through our fulfillment partner. See our Shipping Policy for production and delivery estimates. We are not responsible for delays caused by carriers, customs, or events outside our reasonable control.
7. Returns and refunds
Because pieces are produced on demand, returns are limited to defects and shipping damage. See our Returns & Refunds Policy for the full terms.
8. Intellectual property
All Holotype trademarks, artwork, photography, copy, and software are owned by Holotype or its licensors and are protected by intellectual- property law. You may not reproduce, redistribute, or commercially use any of it without prior written permission, except for the ordinary use of pieces you have acquired (wearing, displaying, gifting).
The underlying scientific data (molecular structures, star coordinates, equations) is in the public domain; the rendering, composition, and brand presentation are not.
9. Acceptable use
Do not attempt to scrape, reverse-engineer, or interfere with the Service; do not submit content that is unlawful, infringing, or abusive; do not impersonate another person or entity.
10. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Holotype disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, Holotype’s aggregate liability arising out of or relating to the Service or any order is limited to the amount you paid for the order giving rise to the claim. In no event will Holotype be liable for any indirect, incidental, consequential, or punitive damages.
12. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
13. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the “Effective” date above. Your continued use of the Service after a change constitutes acceptance of the updated Terms.
